These terms set out the rights, obligations, and responsibilities between DashCaptain (operated by Dalin Soft, the "Service") and its users, for using the Service as a smartphone video recording and clip management tool.
2. Description of the Service
Video and audio recording using your smartphone's camera and microphone
Recording settings such as quality, field of view, camera, auto-stop, and charging-linked recording
On-device storage, rolling deletion, playback, zoom, and sharing of recorded clips
Google AdMob ads to keep the Service free
The Service does not provide sign-up, login, cloud storage, or remote monitoring features.
3. Notice and changes to the terms
The Service posts these terms within the app or on a web page so that users can easily read them.
The Service may amend these terms to the extent permitted by law.
When there is a material change, the effective date and reason will be announced in the app or on the official web page at least 7 days before it takes effect.
4. Obligations of users
When recording, storing, or sharing video, users must comply with relevant laws and the rights of others, including privacy, portrait rights, confidentiality of communications, and traffic regulations.
On private property or in places where filming is restricted, users must follow the instructions of the site's manager.
Users must not operate the app while driving; settings should be changed before departure or while safely stopped.
Users are responsible for viewing, copying, sharing, and submitting their recordings, and must not use the Service for unlawful surveillance, distribution, or to infringe the rights of others.
5. Permissions and use of device features
Camera: used to record video.
Microphone: used to record ambient sound together with the video.
Notifications and foreground service: used to show recording status and keep recording active while the screen is off or another app is in use.
Ignore battery optimizations: used to reduce the chance that recording stops because the CPU sleeps.
If required permissions are not granted, some or all recording features may be unavailable.
6. Storage and deletion of recordings
Video and audio clips and settings are stored on the user's device and are not transmitted to or stored on the operator's servers.
Completed clips may be automatically deleted, oldest first, according to the app's retention policy.
Recordings may be deleted or damaged due to app removal, clearing app data, device reset, insufficient storage, file corruption, or operating system or device errors.
Users should export or back up important footage to a safe location themselves before it is automatically deleted.
7. External sharing and ads
The Service transfers a selected clip to an external app through Android's sharing feature only when the user actively initiates the share action. Once shared, the terms and privacy policy of the external service the user chose apply to any further storage, processing, or transmission.
To keep the Service free, it uses Google AdMob (Google Mobile Ads), and full-screen ads may be shown when recording starts or ends.
In the course of delivering ads, Google and its advertising partners may process some information, such as advertising identifiers, IP address, app interactions, and diagnostics, for the purposes of ad delivery, performance measurement, analytics, and fraud prevention.
Whether and which ads are shown may vary depending on external ad networks, and details of information processing follow the Privacy Policy and Google's policies.
8. Changes and suspension of the Service
The Service may change its features, or temporarily or permanently suspend them, for operational reasons such as differences between devices, operating systems, or camera manufacturers, maintenance, bug fixes, or policy changes.
9. Limits of smartphone recording and disclaimer
⚠️ This Service is a supplementary recording tool using a smartphone and does not replace a dedicated dashcam, safety device, or accident-prevention equipment.
The Service does not guarantee recording in every situation, continuity of recording, file integrity, identification of license plates or voices, or admissibility or legal effect as accident evidence.
Recording may stop or be missed due to camera conflicts with other apps, permission changes, operating system background restrictions, insufficient storage, overheating, battery drain, interrupted charging, or device shutdown or failure.
Ultra-wide behavior, quality, rotation, audio, and charge detection may vary by device and lens.
Before driving, users should check the camera direction, field of view, available storage, charging status, and whether recording is actually running.
To the extent permitted by law, the Service is not liable for damages arising from the device characteristics, user settings, external environment, or force majeure described above.
10. Intellectual property
Intellectual property rights in the Service's program, UI, text, and other content belong to Dalin Soft or its rightful owners. Rights in footage a user personally records belong to that user, to the extent they do not infringe applicable law or the rights of third parties.
11. Governing law and jurisdiction
These terms are governed by the laws of the Republic of Korea, and disputes between the Service and users will be brought before the competent court under the Korean Civil Procedure Act.
